Jeffrey Newton, 52, was driving his motorcycle through an uncontrolled intersection. While in the intersection, Steven Giambruno was driving a semi-truck as part of his employment with Freight Logistics Inc. Giambruno allegedly turned left in front of Newton.
The motorcycle and the truck crashed and Newton was ejected from his motorcycle and landed on the pavement.
He sustained a fractured left hand, fractured ribs and a pneumothorax, which is a collapsed lung.
Newton underwent multiple surgeries and was later fitted for a hand prosthesis. The medical expenses related to Newtown’s injuries totaled approximately $310,000.
Newton was an executive producer and as a result of this incident was unable to continue working due to reduced functioning in his left hand. He incurred an indeterminate amount of lost income.
Newton claimed Freight Logistics was liable for Giambruno’s choosing not to yield the right-of-way at the intersection.
Before the lawsuit was filed, the case settled for $1 million, which was the policy limits of the defendant, Freight Logistics.
The attorneys representing Jeffrey Newton were Jed Aurzban and Lauren Gallagher.
Newton v. Freight Logistics, Inc., (settled before filing).
