$35.3 Million Jury Verdict in Late Diagnosis of Acute Abdominal Emergency

When Parker Patton was 7 days old, he began vomiting yellow bile and became inconsolable. A pediatrician attributed his symptoms to gas.

Parker was diagnosed as having volvulus nine hours later, which resulted in ischemia and the loss of his entire small intestine and half of his large intestine. Parker subsequently underwent a small bowel, liver and pancreas transplant. Now 5 years old, Parker has since been diagnosed as having autism spectrum disorder and developmental delays.

Parker, through his parents, sued the pediatrician, alleging that he chose not to timely diagnose the volvulus in considering the child’s symptoms and immediately transfer him to a tertiary care center.

After a jury trial, the jury signed a verdict for $35.3 million.
