Jason Suplivio underwent shoulder surgery at the Seattle Surgery Center. After the procedure, while he was seated in a chair and still under general anesthesia, nurses removed his safety restraints.
Suplivio leaned forward and fell, striking his head against a hard floor. This resulted in a brain injury that has impacted his ability to work, his personal relationships and his ability to enjoy life.
Suplivio and his wife sued Proliance Surgeons Inc. d/b/a Seattle Surgery Center and an anesthesiologist, Dr. Cameron Cartier, alleging medical negligence and negligent infliction of emotional distress.
The Suplivio family asserted that the defendant negligently removed the safety restraints and chose not to pay attention to Suplivio before he fell to the floor.
The jury signed a verdict of approximately $8.1 million, including $380,500, to Suplivio for loss of consortium. Under an agreement between the parties, the defendants are each 50% responsible.
