$200,000 Settlement Reached in Failure to Properly Assess a Nursing Home Resident’s Skin Condition

Frances Weissman, 79, was admitted to Kyffin Grove Nursing Home. At the time, she required assistance with activities of daily living and nursing care due to her medical history, which included peripheral vascular disease.

While Weissman was at this facility, her medical condition declined. She suffered multiple falls. After experiencing hypoxia and shortness of breath, Weissman was admitted to a hospital where she was diagnosed with having pressure sore injuries.

Weissman later returned to Kyffin Grove Nursing Home but developed new necrotic pressure sore wounds. She was taken to a hospital and discharged to another facility where she died within two months of that admission.

Weissman was survived by her sister.

Weissman’s sister, on behalf of the estate, sued the owners and operators of Kyffin Grove Nursing Home, alleging it chose not to provide adequate care in violation of the applicable standard of care. Plaintiff claimed that the defendants failed to properly assess Weissman’s skin condition and the risk of skin breakdown, failed to turn and reposition her and failed to train staff regarding wound prevention.

Before a jury trial, the parties settled for $200,000.
