$14.7 Million Jury Verdict in Inadequate Care, Monitoring at Nursing Home

Horace Brakes Jr. suffered from various medical conditions and cognitive changes. He was unable to care for himself and was admitted to Krystal Bay Nursing and Rehabilitation.

During this admission, he suffered from pressure wounds, infections, malnutrition and dehydration. He later died.

The Brakes’ estate sued the nursing home’s licensee and management company, alleging claims for wrongful death and survival.  The estate alleged that the defendants chose not to prevent physical injury, properly assess and prevent skin breakdown, provide appropriate hygiene, prevent falls and inform his family of the changes in his medical condition.

After a jury trial, the jury signed a verdict in the amount of $14.7 million finding the defendants equally liable.
