Inadequate Staff Training at Nursing Home Results in $195,000 Settlement

Ms. Doe was in her 60s when she was admitted to the Roe Skilled Nursing Facility after undergoing hip replacement surgery.

She asked for assistance with transferring herself from her bed or chair to the bathroom. A certified nursing assistant who had never worked with her before answered her call. Before Ms. Doe moved to a seated position, the nursing assistant dropped her legs over the bed. This caused her to suffer a broken right femur.

The nursing home’s staff chose not to evaluate Ms. Doe despite her pain after her fall. Ms. Doe was transferred to a nearby hospital that evening where she received the diagnosis of a fractured right femur.

Ms. Doe required additional surgery. She continued to suffer pain, necessitating additional medication; she also reduced her level of mobility. She is now u able to continue working for a medical foundation where she had earned $170,000 per year.

Ms. Doe sued the skilled nursing facility, claiming that it had chosen not to properly train the assistant regarding the handling of post-surgical patients such as Ms. Doe. The lawsuit also alleged elder abuse for the defendant’s choosing not to obtain timely medical care for Ms. Doe after she fell.

The defendant argued that Ms. Doe’s injuries resulted from her pre-existing back problems, not her fractured femur.

The parties settled confidentially for $195,000. The attorneys handling this case for Ms. Doe were Daniel Hodes and Benjamin Ikuta.
