$2 Million Jury Verdict for Injured Patient Caused by Misplacement of Surgical Mesh

Lynne Niemynski, 63, suffered from stress incontinence. She saw Dr. Arthur Thorpe Jr. a gynecologist, who recommended a transobturator urethral sling to improve her condition. She underwent this procedure.

However, for the next nine months, she complained of worsening symptoms, including bladder spasms, discharge and bleeding. Even with application of creams and other medications, her symptoms continued on.

Niemynski finally met with another gynecologist who examined her bladder and discovered a section of surgical mesh that had golf-ball sized crystalline stone growing from it.

She underwent surgery to remove that mesh and stone from her bladder, which improved her condition. Even so, she continued to suffer from infection and pain in addition to bladder spasms, which had not lessened.

She and her husband filed a lawsuit against Dr. Thorpe alleging that he misplaced the mesh in her bladder during her first surgery and chose not to timely remove it. The lawsuit did not claim lost income.

The jury signed a verdict for $2 million in favor of Niemynski against Dr. Thorpe. The attorney who successfully handled this trial for the Niemynskis was Michael W. Calder.

At trial, Niemynski’s counsel presented experts in urogynecology, urology and lifecare planning. The defense for Dr. Thorpe presented a urogynecologist for his expert.
