Breach of Contract Lawsuit Brings $311,640 Jury Verdict; Includes More Than $88,000 in Interest

Tire Services Co. and AA Truck & Trailer Repair entered into an agreement that called for plaintiff Tire Services to sell approximately $450,000 worth of tires to AA Truck. AA Truck agreed and took delivery, but paid just $231,142 of that amount before it stopped making payments in December 2009. 

When the payments stopped, Tire Services filed suit in the Circuit Court of Cook County against AA Truck for the balance remaining unpaid, — $223,326 pursuant to the parties’ contract.

AA Truck claimed that it stopped making payments because the sales terms were confusing and that allegedly Tire Services changed the prices of the tires it sold to AA Truck. 

Tire Services maintained that the pricing was clear as evidenced on invoices delivered to the defendant AA Truck.  Tire Services also argued that AA Truck accepted all of the tires that were sold and delivered. 

The jury deliberated just over an hour, including lunch, before returning its verdict of $223,326 for breach of contract, which represents the remaining unpaid balance under the terms of the parties’ agreement. In addition, interest on the unpaid balance of $88,314 was assessed as part of the judgment. Interest was calculated from December 2009 until the date of the judgment.
