{"id":873,"date":"2017-12-28T10:00:49","date_gmt":"2017-12-28T16:00:49","guid":{"rendered":"https:\/\/www.robertkreisman.com\/nursing-home-lawyer\/?p=873"},"modified":"2017-12-27T07:11:56","modified_gmt":"2017-12-27T13:11:56","slug":"appellate-court-reverses-upholding-nursing-homes-arbitration-agreement-even-lack-clear-statement-authority","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/nursing-home-lawyer\/appellate-court-reverses-upholding-nursing-homes-arbitration-agreement-even-lack-clear-statement-authority\/","title":{"rendered":"Appellate Court Reverses, Upholding Nursing Home\u2019s Arbitration Agreement Even with Lack of Clear Statement of Authority"},"content":{"rendered":"<p>A Kentucky appellate court has held that a nursing home arbitration agreement without specific language allowing an attorney-in-fact to waive a resident\u2019s right to a jury trial was enforceable because of a recent U.S. Supreme Court decision.<\/p>\n<p>In reversing the trial court\u2019s denial of the defendant\u2019s motion to compel arbitration, the appeals panel turned to the U.S. Supreme Court case of <a href=\"https:\/\/www.supremecourt.gov\/opinions\/16pdf\/16-32_o7jp.pdf\"><em>Kindred Nursing Centers v. Clark<\/em><\/a>, 137 S.Ct. 1421 (2017). In the <em>Kindred Nursing Centers<\/em> case, the Supreme Court held that the Federal Arbitration Act preempts the state\u2019s \u201cclear statement rule,\u201d which requires a power of attorney to contain an explicit authorization before an attorney-in-fact may waive a principal\u2019s constitutional right to a jury trial. It was held that this case is substantively similar to the <em>Kindred<\/em> case.<\/p>\n<p>In the underlying lawsuit, Jamie Free was admitted to <a href=\"http:\/\/www.genesishcc.com\/RegisWoods\">Regis Woods Care and Rehabilitation Center<\/a>, a long-term care facility. As she was being admitted, Jamie\u2019s daughter, Reyetta Smith, signed an arbitration agreement in her individual and representative capacity. Smith later sued the facility and others claiming common law and statutory violations. The defendant moved to compel arbitration.
