{"id":295,"date":"2015-01-26T10:00:59","date_gmt":"2015-01-26T16:00:59","guid":{"rendered":"http:\/\/www.chicagonursinghomelawyersblog.com\/?p=295"},"modified":"2015-01-24T16:16:18","modified_gmt":"2015-01-24T22:16:18","slug":"illinois-law-aimed-reducing-unlawful-fraudulent-transfers-unrelated-caregivers-elderly-disabled","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/nursing-home-lawyer\/illinois-law-aimed-reducing-unlawful-fraudulent-transfers-unrelated-caregivers-elderly-disabled\/","title":{"rendered":"Illinois Law Aimed at Reducing Unlawful or Fraudulent Transfers to Unrelated Caregivers of the Elderly or Disabled"},"content":{"rendered":"<p>The <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs3.asp?ChapterID=60&amp;ActID=2104\">Illinois Probate Act<\/a> was recently amended to include a new section entitled, \u201c<a href=\"http:\/\/www.ilga.gov\/legislation\/publicacts\/fulltext.asp?Name=098-1093\">Presumptively Void Transfers<\/a>.\u201d 755 ILCS 5\/4(a) et seq. The effective date of the statute was Jan. 1, 2015. The intended purpose of the legislation was to prevent unrelated caregivers from taking advantage of elderly or disabled persons in their making testamentary gifts under duress or under less than forthright circumstances.<\/p>\n<p>In essence, the new statute states that if a \u201ctransfer instrument\u201d is challenged by a court proceeding, there is a rebuttable presumption that the transfer instrument is void if the transferee is a \u201ccaregiver\u201d and the transfer exceeds $20,000. 755 ILCS 5\/4(a)-10(a).<\/p>\n<p>According to the statute, once the presumption is in place, it can be rebutted by the caregiver in two ways:<\/p>\n<p>(1) The caregiver, beneficiary, proves by clear and convincing evidence that the transfer was not the product of fraud, duress or undue influence; or<\/p>\n<p>(2) By showing that the beneficiary\u2019s share under the transfer instrument is not greater than the beneficiary\u2019s share already in the effect prior to becoming a caregiver. 755 ILCS 5\/4(a)-1(15)(2) and 10(a).<\/p>\n<p> <a href=\"https:\/\/www.robertkreisman.com\/nursing-home-lawyer\/illinois-law-aimed-reducing-unlawful-fraudulent-transfers-unrelated-caregivers-elderly-disabled\/#more-295\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Illinois Probate Act was recently amended to include a new section entitled, \u201cPresumptively Void Transfers.\u201d 755 ILCS 5\/4(a) et seq.
