{"id":3238,"date":"2016-10-07T10:00:38","date_gmt":"2016-10-07T15:00:38","guid":{"rendered":"http:\/\/www.robertkreisman.com\/medical-malpractice-lawyer\/?p=3238"},"modified":"2016-10-05T07:22:42","modified_gmt":"2016-10-05T12:22:42","slug":"illinois-supreme-court-reverses-dismissal-time-barred-complaint-wrongful-death-survival-acts","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/medical-malpractice-lawyer\/illinois-supreme-court-reverses-dismissal-time-barred-complaint-wrongful-death-survival-acts\/","title":{"rendered":"Illinois Supreme Court Reverses Dismissal of Time-Barred Complaint Under Wrongful Death and Survival Acts"},"content":{"rendered":"<p>The appeal to the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Supreme_Court_of_Illinois\">Illinois Supreme Court<\/a> arose from the Circuit Court of Peoria County, which granted the motion of the defendants, Dr. Clarissa Rhode and <a href=\"http:\/\/ciraradiology.com\/\">Central Illinois Radiological Associates Ltd.<\/a> The plaintiff &#8212; Randall Moon &#8212; filed a complaint under the Illinois Wrongful Act (740 ILCS 180\/1, et seq.) and the Survival Act (755 ILCS 5\/27-6). The complaint was dismissed as time-barred. The Illinois Appellate Court affirmed the dismissal and held that the two-year statute of limitations for filing the complaint began to run at the time of the decedent\u2019s death and not after the plaintiff discovered defendants\u2019 alleged medical negligence. <\/p>\n<p>On May 18, 2009, Randall Moon\u2019s mother, 90-year-old Kathryn Moon, was admitted to Proctor Hospital in Peoria, Ill., for <a href=\"http:\/\/www.webmd.com\/digestive-disorders\/tc\/rectal-prolapse-topic-overview#1\">rectal prolapse<\/a>. On May 20, 2009, she underwent a <a href=\"https:\/\/www.urmc.rochester.edu\/encyclopedia\/content.aspx?ContentTypeID=135&#038;ContentID=53\">perineal proctectomy<\/a>. During her hospitalization, she experienced numerous complications including labored breathing, pain, fluid overload, pulmonary infiltrates, <a href=\"http:\/\/emedicine.medscape.com\/article\/372053-overview\">pneumoperitoneum<\/a>, sepsis and an elevated white blood cell count.  <\/p>\n<p>On May 23, a CT scan of her chest and abdominal area was ordered. Dr. Rhode, a radiologist, read the CT scans on May 24, 2009. Randall W. Moon, who is Kathryn Moon&#8217;s son and the plaintiff in this case, returned from out-of-state to his mother\u2019s bedside on the evening of May 27, 2009. Her oxygen levels had significantly dropped and she was not awake or responsive.
