Hemminger, who sued the defendants Jeffrey LeMay, M.D. and Sterling Rock Falls Clinic Ltd. for damages related to the death of his wife, Tina.<span>\u00a0 <\/span>The lawsuit alleged that the defendants, in choosing not to correctly diagnose and treat Tina\u2019s cervical cancer in a timely manner, was the cause of her death by lessening her chance for survival.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">This is called the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Loss_of_chance_in_English_law\">lost chance doctrine<\/a> supported by the case of <a href=\"http:\/\/law.justia.com\/cases\/illinois\/supreme-court\/1997\/79957.html\"><i>Holton v. Memorial Hospital<\/i><\/a>, 176 Ill.2d 95 (1997) in which the Illinois Supreme Court held that \u201cto the extent a plaintiff\u2019s chance of recovery or survival is lessened by the malpractice, he or she should be able to present evidence to a jury that the defendant\u2019s malpractice, to a reasonable degree of medical certainty, proximately caused the increased risk of harm or lost chance of recovery.\u201d<\/p>\n<p class=\"MsoNormal\">In this case, the trial judge granted the defendants\u2019 motion for a directed verdict after the close of plaintiff\u2019s case alleging that plaintiff failed to present evidence sufficient to establish that Dr. LeMay\u2019s negligence proximately caused Tina\u2019s death under a lost chance of survival.<span>\u00a0 <\/span>The plaintiff appealed.<\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/medical-malpractice-lawyer\/illinois-appellate-court-reverses-dismissal-medical-negligence-case-based-experts-testimony\/#more-1456\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A medical malpractice lawsuit was filed by Daniel R.
