{"id":1070,"date":"2013-08-08T10:00:35","date_gmt":"2013-08-08T16:00:35","guid":{"rendered":"http:\/\/www.chicagomedicalmalpracticeattorney-blog.com\/?p=1070"},"modified":"2016-08-29T14:52:33","modified_gmt":"2016-08-29T19:52:33","slug":"medical-malpractice-case-shut-down-by-plaintiffs-a-late-expert-disclosure","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/medical-malpractice-lawyer\/medical-malpractice-case-shut-down-by-plaintiffs-a-late-expert-disclosure\/","title":{"rendered":"Medical Malpractice Case Shut Down by Plaintiff\u2019s Late Expert Disclosure"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">Bozena Smith filed a medical negligence complaint against two doctors who were residents in 2006 when she claims she was injured\u00a0in postsurgical treatment.<\/p>\n<p class=\"MsoNormal\">After the fact discovery was done by each of the parties, and the trial judge entered a deadline of Sept. 13, 2010 for the plaintiff to disclose any experts and opinions.<span>\u00a0<\/span>Bozena disclosed one expert she had hired to render an opinion.<span>\u00a0<\/span>In the <a href=\"http:\/\/www.iltla.com\/publications\/supreme-court-rule-213-once-disclosed-always-disclosed\/\">Rule 213(f)(3) <\/a>disclosures, the plaintiff stated that the doctor retained as an expert would provide expert opinions that both the residents, Drs. Murphy and McFadden, deviated from the standard of care in treating Smith, which caused her injuries.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">However, on Nov. 8, 2010, when the plaintiff\u2019s expert doctor appeared for his deposition, he testified that he was withdrawing his adverse opinions against the residents and then testified that he held no opinions that implicated the residents in any substandard medical care of the plaintiff.<span>\u00a0<\/span>In fact, the plaintiff\u2019s expert testified as follows:<\/p>\n<p class=\"MsoNormal\" style=\"margin-top: 0in;margin-right: .5in;margin-bottom: .0001pt;margin-left: .5in\"> <a href=\"https:\/\/www.robertkreisman.com\/medical-malpractice-lawyer\/medical-malpractice-case-shut-down-by-plaintiffs-a-late-expert-disclosure\/#more-1070\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bozena Smith filed a medical negligence complaint against two doctors who were residents in 2006 when she claims she was injured\u00a0in postsurgical treatment.
