{"id":5972,"date":"2016-03-29T10:00:01","date_gmt":"2016-03-29T15:00:01","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=5972"},"modified":"2016-03-28T21:30:29","modified_gmt":"2016-03-29T02:30:29","slug":"new-trial-damages-ordered-illinois-appellate-court-car-accident-case","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/new-trial-damages-ordered-illinois-appellate-court-car-accident-case\/","title":{"rendered":"New Trial On Damages Ordered by Illinois Appellate Court in Car Accident Case"},"content":{"rendered":"<p>Miguel Klesowitch filed a lawsuit against the defendant Chiquita Smith to recover for damages allegedly suffered as a result of the defendant\u2019s negligence.\u00a0 The trial judge granted summary judgment in favor of Klesowitch on the issue of defendant\u2019s negligence only, leaving consideration of whether any of the plaintiff\u2019s conduct was a proximate cause of his injuries and the amount of damages for trial.\u00a0 At the trial before the jury, the judge admitted certain medical bills into evidence.\u00a0 Portions of those bills had been written off by the medical providers.\u00a0 The jury returned a verdict in favor of the plaintiff for the full amount of the medical bills admitted into evidence.\u00a0 The verdict was affirmed in part, reversed in part and remanded back to the trial court with instructions.<\/p>\n<p>On June 28, 2008, the plaintiff, Miguel Klesowitch, alleged that the defendant, Chiquita Smith, drove her car into the Klesowitch vehicle.\u00a0 Smith drove her vehicle into an intersection without stopping at a stop sign and into the left side of Klesowitch\u2019s vehicle.\u00a0 Smith admitted not stopping because she did not see the stop sign.\u00a0 The lawsuit complaint alleged that Klesowitch was injured physically, by expending large sums of money for medical expenses to be cured of said physical injuries and by lost money from being unable to pursue his usual occupation.\u00a0 Smith filed an answer and affirmative defenses alleging that Klesowitch was guilty of contributory negligence.<\/p>\n<p>In July 2014, Klesowitch filed a motion for <a href=\"http:\/\/www.nolo.com\/dictionary\/summary-judgment-term.html\">summary judgment<\/a> \u201con the issue of liability.\u201d\u00a0 Klesowitch\u2019s motion asserted that at Smith\u2019s deposition, she \u201cset forth testimony indicating that she was clearly at fault for the accident.\u201d<\/p>\n<p> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/new-trial-damages-ordered-illinois-appellate-court-car-accident-case\/#more-5972\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Miguel Klesowitch filed a lawsuit against the defendant Chiquita Smith to recover for damages allegedly suffered as a result of the defendant\u2019s negligence.\u00a0 The trial judge granted summary judgment in favor of Klesowitch on the issue of defendant\u2019s negligence only, leaving consideration of whether any of the plaintiff\u2019s conduct was a proximate cause of his [&hellip;]<\/p>\n","protected":false},"author":795,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":true,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"enabled":false},"version":2}},"categories":[45,163,73],"tags":[],"class_list":["post-5972","post","type-post","status-publish","format-standard","hentry","category-auto-accidents","category-damages","category-trial-practice"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>New Trial On Damages Ordered by Illinois Appellate Court in Car Accident Case &#8212;
