Relying on the \u201csubstituted judgment\u201d doctrine, his co-guardians, <a href=\"https:\/\/www.northerntrust.com\">Northern Trust Co.<\/a> and LaTanya Turks, argued that Donald would want his money to go to Turks, his mother and full-time caretaker, rather than also being shared under <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs4.asp?ActID=2104&amp;ChapterID=60&amp;SeqStart=3700000&amp;SeqEnd=5000000\">Illinois Intestacy Law<\/a> with family members, which included his father and ten half-siblings born to ten different women who allegedly had no significant role in his life.<\/p>\n<p>Under the <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs4.asp?ActID=2104&amp;ChapterID=60&amp;SeqStart=14300000&amp;SeqEnd=17600000\">Illinois Probate Act, Section 11a-18(a-5)<\/a> authorizes guardians to draft estate plans that depart from the default formula for distributing a decedent\u2019s assets. That section of the statute, which refers to acting \u201cin keeping with the ward\u2019s wishes so far as they can be ascertained,\u201d also says the \u201cward\u2019s wishes, as best they can be ascertained, shall be carried out.\u201d<\/p>\n<p>In this probate matter, the \u201cward\u2019s wishes\u201d provisions were in conflict with the court- appointed guardian ad litem who opposed the estate plan suggested by Northern Trust and Turks.
