The defendants, the <a href=\"http:\/\/www.cichealth.org\/\">Carpenters\u2019 Health and Welfare Trust Fund <\/a>and the trustees of the Carpenters\u2019 Health and Welfare Trust Fund of St. Louis, appealed.<\/p>\n<p>On May 4, 2006, James Corey Miller was injured when he fell from a ladder. Miller was a participant in the defendants\u2019 Plan. The Plan is a self-funded, multi-employer, Employee Welfare Benefit Plan subject to the provisions of the <a href=\"http:\/\/www.dol.gov\/dol\/topic\/retirement\/erisa.htm\">Employee Retirement Income Security Act <\/a>of 1974, as amended, 29 U.S.C. \u00a71001, et seq.
