{"id":5112,"date":"2015-05-08T10:00:33","date_gmt":"2015-05-08T15:00:33","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=5112"},"modified":"2015-05-07T21:06:51","modified_gmt":"2015-05-08T02:06:51","slug":"jury-enters-verdict-of-5-24-million-in-mesothelioma-death","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/jury-enters-verdict-of-5-24-million-in-mesothelioma-death\/","title":{"rendered":"Jury Enters Verdict of $5.24 Million in Mesothelioma Death"},"content":{"rendered":"<p>John Blommer worked as an apprentice carman repairing railroad cars for <a href=\"http:\/\/en.wikipedia.org\/wiki\/Great_Northern_Railway_(U.S.)\">Great Northern Railway<\/a>, which was the predecessor to <a href=\"http:\/\/www.bnsf.com\/\">BNSF Railway Co. <\/a>He started working at the railroad in 1953 and worked for several months before joining the U.S. Army. He returned to the railroad after his military service and then left his employment in 1956 to work at the U.S. Postal Service. In all, Blommer worked for the railroad for a total of nearly 26 months. During that time, he was exposed daily to asbestos from various products he handled. Asbestos was found to be included in pipe wrapping, insulation, raw asbestos fibers and other asbestos-containing products.<\/p>\n<p>In 2010, Blommer, then age 78, was diagnosed with <a href=\"http:\/\/www.mesothelioma.com\/mesothelioma\/\">mesothelioma<\/a>. He underwent chemotherapy treatments and <a href=\"http:\/\/en.wikipedia.org\/wiki\/Pleurodesis\">talc pleurodesis<\/a>, which is a procedure in which fluid is drained from the lining of the lungs; then the ribcage and lining are scraped and filled with a talc product to glue the lungs to the ribcage. The purpose is to prevent the fluid from returning. After about two years, the fluid did return and Blommer underwent additional chemotherapy until the treatments were no longer effective.<\/p>\n<p>Blommer sued BNSF under the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Federal_Employers_Liability_Act\">Federal Employers\u2019 Liability Act (FELA)<\/a> claiming that the railroad chose not to provide a safe workplace by protecting employees from asbestos exposure.<\/p>\n<p> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/jury-enters-verdict-of-5-24-million-in-mesothelioma-death\/#more-5112\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>John Blommer worked as an apprentice carman repairing railroad cars for Great Northern Railway, which was the predecessor to BNSF Railway Co.
