{"id":4859,"date":"2015-02-17T10:00:10","date_gmt":"2015-02-17T16:00:10","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=4859"},"modified":"2015-02-15T18:58:07","modified_gmt":"2015-02-16T00:58:07","slug":"injured-car-rental-customer-entitled-underinsured-motorist-coverage-ahead-rental-car-companys-coverage","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/injured-car-rental-customer-entitled-underinsured-motorist-coverage-ahead-rental-car-companys-coverage\/","title":{"rendered":"Injured Car Rental Customer Entitled to Underinsured Motorist Coverage Ahead of Rental Car Company\u2019s Coverage"},"content":{"rendered":"<h3 class=\"entry-title\"><\/h3>\n<p>The Illinois Appellate Court has reversed a summary judgment order that was entered by a Cook County judge in favor of <a href=\"https:\/\/www.safewayinsurance.com\/default.aspx?Lang=EN\">Safeway Insurance Co. <\/a>In this case, Jeffrey and Stephanie Hadary were injured in a car crash when Carlos Velez was driving a car he rented from <a href=\"https:\/\/www.hertz.com\/rentacar\/reservation\/\">Hertz Corp. <\/a>The Hadarys claimed that they had suffered injuries that amounted to damages in excess of $40,000, which was the insurance limits of Velez\u2019s insurance carrier, <a href=\"https:\/\/www.aains.com\/\">American Access Casualty Co.<\/a>, which had limits of $20,000 per person and $40,000 per accident. The Hadarys reportedly declined to buy the \u201cliability insurance supplement\u201d when they rented the car from Hertz.<\/p>\n<p>Under Illinois\u2019 financial responsibility law, Hertz was bound to provide a bond, an insurance policy or certificate of self-insurance that promised to pay judgments against its customers and anyone driving a Hertz vehicle with a customer\u2019s consent. Section 9-105 of the <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs3.asp?ChapterID=49&amp;ActID=1815\">Illinois Vehicle Code <\/a>required Hertz to provide this liability coverage with limits of (a) $50,000 for injury to one person or damage to property and (b) $100,000 for injuries to two or more persons.<\/p>\n<p>After American Access paid its $40,000 policy limits to Hadarys, who paid $57 as a premium for underinsured motorist coverage from Safeway Insurance Co. with limits of $100,000 per person and $300,000 per occurrence, they alleged that Velez was an underinsured motorist.<\/p>\n<p> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/injured-car-rental-customer-entitled-underinsured-motorist-coverage-ahead-rental-car-companys-coverage\/#more-4859\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Illinois Appellate Court has reversed a summary judgment order that was entered by a Cook County judge in favor of Safeway Insurance Co.
