{"id":4566,"date":"2014-12-18T10:00:27","date_gmt":"2014-12-18T16:00:27","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=4566"},"modified":"2019-10-28T10:33:44","modified_gmt":"2019-10-28T10:33:44","slug":"u-s-district-court-considers-limits-federal-rules-work-product-privilege","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/u-s-district-court-considers-limits-federal-rules-work-product-privilege\/","title":{"rendered":"U.S. District Court Considers Limits of Federal Rules on Work-Product Privilege"},"content":{"rendered":"<p>In a commodities fraud case, it was contended by the plaintiff, the <a href=\"http:\/\/www.cftc.gov\/index.htm\">Commodity Futures Trading Commission<\/a> (CFTC), that previous versions of a defendant expert\u2019s report should be produced and not be privileged because of communications between the lawyer and this expert witness.<\/p>\n<p>In 2010, the work-product privilege provided by Federal Rule of Civil Procedure 26(b)(4)(B) and (C) was extended to cover drafts of reports from experts with three exceptions. This privilege extends to communications between lawyers and experts.<\/p>\n<p>The CFTC argued that the defendants \u201cshould be deemed to have forfeited Rule 26(b)(4)\u2019s work-product protection because there is evidence that defendants\u2019 counsel participated in drafting sections of the report.\u201d The U.S. magistrate judge handling this U.S. District Court case rejected the CFTC\u2019s forfeiture argument stating: \u201cThe CFTC\u2019s approach would require an analysis of the degree of counsel involvement (both quantity and quality) in the drafting of the report. Such an analysis would necessarily require production of all of the drafts of the report for comparison, as well as production of all, or virtually all, communications between expert and counsel.
