{"id":4500,"date":"2014-12-05T10:00:24","date_gmt":"2014-12-05T16:00:24","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=4500"},"modified":"2014-12-03T13:24:23","modified_gmt":"2014-12-03T19:24:23","slug":"9-billion-actos-damage-award-takeda-lilly-upheld","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/9-billion-actos-damage-award-takeda-lilly-upheld\/","title":{"rendered":"$9 Billion Actos Damage Award Against Takeda and Lilly is Upheld"},"content":{"rendered":"<p>A U.S. district court judge has rejected the attempts of <a href=\"http:\/\/www.takeda.us\">Takeda Pharmaceutical Co.<\/a> and <a href=\"http:\/\/www.takeda.us\">Eli Lilly &amp; Co.<\/a> to overturn the combined $9 billion punitive-damage award that a jury recently returned. The verdict came down in a case that involved claims that the drug makers chose to hide the cancer risks of their Actos diabetes drug. The presiding judge held that the jury properly considered evidence that showed officials of the Osaka, Japan-based Takeda, and Indianapolis-based Lily had advance knowledge that <a href=\"http:\/\/en.wikipedia.org\/wiki\/Pioglitazone\">Actos <\/a>was associated with bladder cancer and chose not to properly and efficiently warn doctors and patients about those risks.<\/p>\n<p>However, although the judge upheld the jury\u2019s verdict, the judge is still considering another motion that was brought post-trial by the defendants for a new trial. That motion is pending for a case of <a href=\"http:\/\/dockets.justia.com\/docket\/louisiana\/lawdce\/6:2012cv00064\/121414\">Terrence Allen v. Takeda, et al.<\/a>, which was the first federal trial over claims that Actos causes bladder cancer.<\/p>\n<p>The widespread sales of the Actos pharmaceutical product reached its highest level on March 2011 when the product had sales of $4.5 billion and accounted for 27% of Takeda\u2019s revenue in total. Since the time Actos was released by Takeda in 1999, it had made sales in excess of $16 billion.
