{"id":3448,"date":"2014-04-08T10:00:53","date_gmt":"2014-04-08T15:00:53","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=3448"},"modified":"2014-04-06T08:19:19","modified_gmt":"2014-04-06T13:19:19","slug":"u-s-district-court-throws-class-action-claim-made-property-owners-near-oil-refinery","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/u-s-district-court-throws-class-action-claim-made-property-owners-near-oil-refinery\/","title":{"rendered":"U.S. District Court Throws Out Class-Action Claim Made by Property Owners Near Oil Refinery"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">The U.S. District Court certified a class of property owners in <a href=\"http:\/\/roxana-il.org\/\">Roxana<\/a>, Ill., which is a small town across the Mississippi River from St. Louis.<span>\u00a0 <\/span>In the lawsuit it was claimed that <a href=\"http:\/\/www.shell.us\/?gclid=CICfpbT1y70CFYJmKgodZBQAAA&amp;gclsrc=ds\">Shell Oil<\/a>, together with its subsidiaries, was responsible for the leakage of poisonous <a href=\"http:\/\/en.wikipedia.org\/wiki\/Benzene\">benzene<\/a> and other contaminants into the groundwater under the class members\u2019 homes.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">This case, filed as a diversity lawsuit, charged that the defendants were responsible for the nuisance and related torts in violation of Illinois common law. The property owners sought a remedy for the damages, which they say were primarily the effect of groundwater contamination.<\/p>\n<p class=\"MsoNormal\">The defendants petitioned the U.S. Court of Appeals for leave to appeal the certification of the class.<span>\u00a0 <\/span>The court of appeals decided to grant the request in order to clarify class action law.<span>\u00a0 <\/span>See <i>Blair v.
