A.W. Chesterton Inc.<\/i>,<\/a> it was determined that brakes located onto a rail car are a \u201cpart or appurtenance\u201d to a locomotive and therefore the plaintiff\u2019s state law asbestos claims were pre-empted by the federal <a href=\"http:\/\/www.law.cornell.edu\/uscode\/text\/49\/20701\">Locomotive Inspection Act (LIA)<\/a>.<span>\u00a0\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">Alice Perry brought this lawsuit on behalf of her husband, who died of asbestos-related injuries after installing and removing <a href=\"http:\/\/www.rfpc.com\/\">Railroad Friction Products Corp. <\/a>brake shoes on rail cars.The locomotive is at the front of the train, which pulls the rail cars that carry the cargo of passengers or products.<\/p>\n<p class=\"MsoNormal\">Perry argued that the specific brakes and brake materials that her husband was exposed to were found only in rail cars and not locomotives.
