{"id":3110,"date":"2014-02-19T10:00:59","date_gmt":"2014-02-19T16:00:59","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=3110"},"modified":"2014-02-18T19:01:26","modified_gmt":"2014-02-19T01:01:26","slug":"guardian-disabled-person-can-removed-refusing-follow-recommended-services","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/guardian-disabled-person-can-removed-refusing-follow-recommended-services\/","title":{"rendered":"Guardian of a Disabled Person Can Be Removed for Refusing to Follow Recommended Services"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">The Illinois Appellate Court has affirmed the decision by a Cook County associate judge who ordered the removal of the guardian of a disabled person.<\/p>\n<p class=\"MsoNormal\">On Feb. 24, 2009, Patricia Herard was adjudicated by the court to be disabled.<span>\u00a0<\/span>Herard was diagnosed with \u201cprofound mental retardation and legal blindness.\u201d<span>\u00a0 <\/span>It was also reported that she has epilepsy, behavior reminiscent of autism and functioning \u201cin the age ranges of 9 months to just fewer than 3 years.\u201d<span>\u00a0<\/span>Patricia\u2019s mother was appointed her legal guardian.<\/p>\n<p class=\"MsoNormal\">An agreement was signed and delivered to the court between Herard\u2019s parents, her <a href=\"http:\/\/en.wikipedia.org\/wiki\/Legal_guardian\">guardian ad litem<\/a> and the <a href=\"https:\/\/www.bankofamerica.com\/\">Bank of America<\/a>.<span>\u00a0 <\/span>The agreement required Herard\u2019s parents to grant reasonable access to Herard for a court-appointed case manager, in this case, <a href=\"http:\/\/www.rehabassist.com\/\">Rehab Assist Guardianship Services<\/a>.<span>\u00a0 <\/span>The reasonable access was intended to include both announced and unannounced visits.<\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/guardian-disabled-person-can-removed-refusing-follow-recommended-services\/#more-3110\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Illinois Appellate Court has affirmed the decision by a Cook County associate judge who ordered the removal of the guardian of a disabled person.
