{"id":2431,"date":"2013-12-02T10:00:12","date_gmt":"2013-12-02T16:00:12","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=2431"},"modified":"2019-10-28T10:34:53","modified_gmt":"2019-10-28T10:34:53","slug":"court-decides-several-counts-complaint-counts-time-period-filing-appeal-decided-counts-begin","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/court-decides-several-counts-complaint-counts-time-period-filing-appeal-decided-counts-begin\/","title":{"rendered":"Where Court Decides Several Counts of Complaint But Not All Counts, The Time Period for Filing an Appeal on the Decided Counts Begin"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">Anthony Williams filed a lawsuit against <a href=\"http:\/\/www.bnsf.com\/\">BNSF Railway Co. <\/a>under the <a href=\"http:\/\/en.wikipedia.org\/wiki\/Federal_Employers_Liability_Act\">Federal Employers Liability Act <\/a>(FELA) (45 U.S.C. \u00a751) (2006) claiming an employment-related injury.<span>\u00a0<\/span>BNSF filed a third-party complaint for contribution and contractual indemnification against third-party defendant Quality Terminal Services (QTS).<span>\u00a0<\/span>At the jury trial, a verdict in favor of Williams was returned with total damages in the amount of $2,676,950.<span>\u00a0<\/span>However, the jury assigned 50 percent of the negligence in the case to Williams and divided the remaining responsibility at 37.5 percent to BNSF and 12.5 percent to QTS.<span>\u00a0<\/span>The jury also returned a verdict in favor of QTS on BNSF\u2019s contractual indemnity claim.<\/p>\n<p class=\"MsoNormal\">BNSF appealed claiming that the circuit court erred in denying its motion for a directed verdict on the contractual indemnity claim.<span>\u00a0<\/span>BNSF also maintained that the trial judge erred in refusing to allow evidence related to Williams\u2019s termination of employment with BNSF.<span>\u00a0<\/span>And finally, BNSF contended that the circuit court erred in allowing evidence of the loss of household services, including unsupported opinion testimony regarding the value of those services.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">At the outset, Williams and QTS argued that the appellate court lacked jurisdiction to decide this appeal because BNSF did not file its notice of appeal within 30 days of the trial court\u2019s oral ruling on all posttrial motion.<span>\u00a0<\/span>Williams filed a motion to dismiss the appeal for lack of jurisdiction and QTS joined.<span>\u00a0<\/span>The appellate court noted that in <i>Lebron v.
