{"id":2416,"date":"2013-11-27T10:00:09","date_gmt":"2013-11-27T16:00:09","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=2416"},"modified":"2013-11-24T08:25:25","modified_gmt":"2013-11-24T14:25:25","slug":"illinois-appellate-court-affirms-good-faith-settlement-third-party","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/illinois-appellate-court-affirms-good-faith-settlement-third-party\/","title":{"rendered":"Illinois Appellate Court Affirms Good Faith Settlement of Third Party"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">On Sept. 24, 2006, the car being driven by Keisha Geans, who was driving while under the influence of alcohol, crashed into a concrete barrier, overturned and collided with the Miranda family car.<span>\u00a0<\/span>Marco Miranda, who was 12, was left permanently disabled after suffering a serious brain injury.<span>\u00a0<\/span>Geans\u2019 <a href=\"http:\/\/en.wikipedia.org\/wiki\/Blood_alcohol_content\">blood alcohol level <\/a>was .229, which is almost three times the legal limit.<span>\u00a0 <\/span>Geans pleaded guilty to fourth-degree <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/fulltext.asp?DocName=062500050K11-501\">aggravated driving<\/a> under the influence.<span>\u00a0<\/span>The Miranda family sued for their injuries.<\/p>\n<p class=\"MsoNormal\">On Dec. 12, 2008, <a href=\"http:\/\/www.uicnc.com\/\">Universal Insurance Co.<\/a>, Geans\u2019 insurer, paid the Miranda family the policy limits of $20,000.<span>\u00a0<\/span>In return, the Miranda family released all claims against Geans and Universal.<span>\u00a0<\/span>After the settlement was finalized, the Miranda family then filed an amended complaint adding the <a href=\"http:\/\/www.walshgroup.com\/\">Walsh Group<\/a>, a construction company.<span>\u00a0<\/span>That was filed on Nov. 29, 2010.<span>\u00a0<\/span>The Miranda family sued Walsh for negligence, alleging that the concrete barrier it placed on the side of the road was done negligently and was a contributing cause of the crash.<\/p>\n<p class=\"MsoNormal\">The Miranda family also then sued for contribution \u00a0against Geans, alleging that Geans\u2019 driving was a proximate cause of Marco Miranda\u2019s injuries.<span>\u00a0<\/span>Geans moved to dismiss claiming that the settlement had ended any liability as to her.<\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/illinois-appellate-court-affirms-good-faith-settlement-third-party\/#more-2416\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Sept. 24, 2006, the car being driven by Keisha Geans, who was driving while under the influence of alcohol, crashed into a concrete barrier, overturned and collided with the Miranda family car.\u00a0Marco Miranda, who was 12, was left permanently disabled after suffering a serious brain injury.\u00a0Geans\u2019 blood alcohol level was .229, which is almost [&hellip;]<\/p>\n","protected":false},"author":795,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":false,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"enabled":false},"version":2}},"categories":[45,5,46,85],"tags":[],"class_list":["post-2416","post","type-post","status-publish","format-standard","hentry","category-auto-accidents","category-car-accidents","category-civil-procedure","category-head-injuries"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Illinois Appellate Court Affirms Good Faith Settlement of Third Party &#8212;
