{"id":2110,"date":"2013-09-04T10:00:23","date_gmt":"2013-09-04T15:00:23","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=2110"},"modified":"2019-10-17T10:52:28","modified_gmt":"2019-10-17T10:52:28","slug":"u-s-court-of-appeals-finds-no-copyright-violation-where-two-songs-shared-only-characteristics-common-and-essential-to-their-genre","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/u-s-court-of-appeals-finds-no-copyright-violation-where-two-songs-shared-only-characteristics-common-and-essential-to-their-genre\/","title":{"rendered":"U.S. Court of Appeals Finds No Copyright Violation Where Two Songs Shared Only Characteristics Common and Essential to their Genre"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">The 7<sup>th<\/sup> Circuit Court of Appeals in Chicago has affirmed a ruling by the federal district court judge over a copyright lawsuit involving a song.<span>\u00a0<\/span>Guy Hobbs composed a song entitled \u201cNatasha\u201d while working on a Russian cruise ship.<span>\u00a0 <\/span>This song was registered as a copyright in the United Kingdom in 1983.<span>\u00a0 <\/span>His attempts to publish the song were unsuccessful.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">A few years later, <a href=\"http:\/\/www.eltonjohn.com\/\">Elton John <\/a>and <a href=\"http:\/\/www.berniejtaupin.com\/\">Bernie Taupin<\/a> released a song entitled \u201cNikita.\u201d<span>\u00a0\u00a0<\/span><a href=\"http:\/\/en.wikipedia.org\/wiki\/Nikita_(song)\">\u201cNikita\u201d <\/a>was released through a publishing company; Hobbs had sent a copy of \u201cNatasha\u201d<span>\u00a0 to the same company.\u00a0<\/span>Hobbs believed that \u201cNikita\u201d was a knock-off of his song \u201cNatasha\u201d and demanded compensation from John and Taupin.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">Hobbs was unsuccessful, and he filed suit in 2012 asserting copyright infringement.<span>\u00a0<\/span>The U.S. District Court dismissed Hobbs\u2019 suit for failure to state a claim;
