{"id":2055,"date":"2013-08-19T10:00:52","date_gmt":"2013-08-19T15:00:52","guid":{"rendered":"http:\/\/injury.robertkreisman.com\/?p=2055"},"modified":"2013-08-18T09:55:57","modified_gmt":"2013-08-18T14:55:57","slug":"court-holds-health-care-lien-appropriate-in-underinsured-motorist-claim","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/injury-lawyer\/court-holds-health-care-lien-appropriate-in-underinsured-motorist-claim\/","title":{"rendered":"Court Holds Health-Care Lien Appropriate in Underinsured Motorist Claim"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">The Illinois Appellate Court weighed the application of the <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs3.asp?ActID=2498&amp;ChapterID=63\">Illinois Health-Care Services Lien Act <\/a>in an underinsured-motorist case.<span>\u00a0<\/span>On Nov. 5, 2009, in Murphysboro, Ill., a car driven by Lori Maramba crossed the center line and struck a vehicle driven by David McRoberts.<span>\u00a0<\/span>Caitlyn McRoberts and Kim McRoberts were passengers with David McRoberts, all of whom suffered injuries and damages.<span>\u00a0<\/span>The defendant had a liability insurance coverage limit of $50,000.<span>\u00a0<\/span>The McRoberts family collected all of that and additionally made claim under their underinsured-motorist benefits policy.<span>\u00a0<\/span>The underinsurance allowed for the payment of an additional $50,000 to the McRoberts family.<\/p>\n<p class=\"MsoNormal\">The medical bills paid to the McRoberts family exceeded the settlement.<span>\u00a0<\/span>That included the payment of both the tortfeasor\u2019s insurance policy and the McRoberts family\u2019s underinsurance policy.The total amount of the medical bills incurred was in excess of $321,000.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">Several of the health-care providers filed liens in compliance with the Health-Care Services Lien Act.<span>\u00a0<\/span>The plaintiffs, the McRoberts family, filed a petition to adjudicate the medical liens on Dec. 1, 2011.<span>\u00a0<\/span>The trial court held a hearing on the petition on Dec. 9, 2011.
