Schwan\u2019s Home Service"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">In a wrongful discharge case brought by Larry Holland, there was evidence against his former employer, <a href=\"http:\/\/www.schwans.com\/\">Schwan\u2019s Home Service<\/a>, that included the claim file of Schwan\u2019s insurance carrier.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">The claim adjuster\u2019s file contained notes from Joan Kantor, a specialty risk services third-party administrator for <a href=\"http:\/\/www.thehartford.com\/\">Hartford Insurance Co. <\/a>The notes contained summaries of conversations with Schwan\u2019s agents and employees.<span>\u00a0<\/span>Kantor did not testify at the trial.<span>\u00a0<\/span>Schwan\u2019s objected to the conclusion of the notes as evidence arguing that (1) the statements were inadmissible hearsay, (2) the documents were protected by attorney-client privilege and (3) the business records exception to the hearsay rule did not apply because the claim file was prepared in anticipation of litigation.<\/p>\n<p class=\"MsoNormal\">The jury in Benton, Ill., returned a verdict for Holland for $4,260,400, which included $3.6 million in punitive damages.<span>\u00a0 <\/span>Schwan\u2019s Home Service appealed.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/illinois-appellate-court-affirms-that-insurance-claim-file-was-admissible-evidence-at-trial-holland-v-schwans-home-service\/#more-2028\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In a wrongful discharge case brought by Larry Holland, there was evidence against his former employer, Schwan\u2019s Home Service, that included the claim file of Schwan\u2019s insurance carrier.\u00a0 The claim adjuster\u2019s file contained notes from Joan Kantor, a specialty risk services third-party administrator for Hartford Insurance Co.
