System Transport"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p>In 2007, Illinois amended the <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs3.asp?ActID=2059&amp;ChapterID=57\">Wrongful Death Act<\/a> to add language saying, \u201cincluding damages for grief, sorrow and mental suffering.\u201d The language was added to the description of available wrongful death damages.<\/p>\n<p class=\"MsoNormal\">According to this Chicago federal court case, <a href=\"http:\/\/law.justia.com\/cases\/federal\/district-courts\/illinois\/ilcdce\/1:2011cv01295\/52790\/62\"><i>Hammond v. System Transport, Inc.<\/i><\/a>, the Illinois legislature\u2019s intentions in amending the wrongful death statute \u201cwas to compensate for the spouse\u2019s and next of kin\u2019s emotional consequences from the end of a decedent\u2019s life, including the process or manner of death.\u201d<span>\u00a0 <\/span>The damages, grief, sorrow and mental suffering resulting from the manner of death may be compensable under the Wrongful Death Act, according to the case opinion.<\/p>\n<p class=\"MsoNormal\">However, the court held that \u201cevidence of defendant Austin\u2019s [the truck driver&#8217;s] negligence, such as the allegation that he violated rules limiting the hours he could work before resting, which resulted in his falling asleep and running a stop sign, is not relevant to plaintiff\u2019s claim.\u201d<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/2007-amendment-to-illinois-wrongful-death-act-plays-out-in-federal-court-case-hammond-v-system-transport\/#more-1822\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In 2007, Illinois amended the Wrongful Death Act to add language saying, \u201cincluding damages for grief, sorrow and mental suffering.\u201d The language was added to the description of available wrongful death damages.
