Cvejin"},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">A breach of contract case was interrupted by the death of the individual plaintiff, Theodore Sarche.<span>\u00a0<\/span>Mr. Sarche\u2019s death led to his law firm moving to appoint a special representative under <a href=\"http:\/\/codes.lp.findlaw.com\/ilstatutes\/735\/5\/II\/2-1008\">Section 2-1008(a) of the Illinois Code of Civil Procedure<\/a>.<\/p>\n<p class=\"MsoNormal\">An affidavit was later supplied by Sarche\u2019s sole surviving child, Michael Sarche, who attested that he authorized his father\u2019s law firm to continue prosecuting the case against the defendant.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">Michael Sarche did not open a probate estate because his father had limited assets.<span>\u00a0<\/span>Michael was living in Colorado.<span>\u00a0<\/span>Based on Michael\u2019s instructions, the law firm moved to substitute Carol Mohica, a paralegal at the law firm, to act as plaintiff under the special representative piece of that statute.<\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/illinois-appellate-court-reverses-trial-court-in-substitution-of-party-mohica-v-cvejin\/#more-1640\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>A breach of contract case was interrupted by the death of the individual plaintiff, Theodore Sarche.\u00a0Mr. Sarche\u2019s death led to his law firm moving to appoint a special representative under Section 2-1008(a) of the Illinois Code of Civil Procedure.
