Rea, et al."},"content":{"rendered":"<p><!--[if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">In 2003, plaintiff Amy Stanton was a passenger in a car driven by the defendant, Carolyn Rea.<span>\u00a0<\/span>Stanton was injured and hospitalized after the car crashed.<span>\u00a0<\/span>The driver of the other vehicle in the accident was uninsured.<span>\u00a0<\/span>In October 2007 the case proceeded to a jury trial.<span>\u00a0<\/span>The trial judge entered a verdict on liability against Rea on the issue of liability.<span>\u00a0<\/span>The case was then submitted to the jury on the issue of damages wherein a verdict in the amount of $13,506.80 was entered.<span>\u00a0<\/span>The trial judge then entered an added judgment in the amount of $4,501.44 for out-of-pocket expenses related to the bringing of the case through trial.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\">The issue on appeal to the <a href=\"http:\/\/www.state.il.us\/court\/appellatecourt\/\">Illinois Appellate Court, Fifth District,<\/a> was the adjudication of the health care providers\u2019 liens.<span>\u00a0<\/span>There was a total of $5,806.02 in medical liens.<span>\u00a0<\/span>At the trial level, the judge applied the <a href=\"http:\/\/www.ilga.gov\/legislation\/ilcs\/ilcs3.asp?ActID=2498&amp;ChapterID=63\">Illinois Health Care Services Lien Act <\/a>(770 ILCS 23\/1) as to the adjudication of the medical liens.<span>\u00a0<\/span>It required that plaintiff\u2019s counsel reduce attorney fees to 30% of the verdict.<span>\u00a0<\/span>The Health Care Services Lien Act maximizes at 40% of the amount of the verdict to the payment of medical liens.<span>\u00a0<\/span>This would allow a plaintiff to receive no less than 30% of the judgment or settlement.<\/p>\n<p class=\"MsoNormal\">The error in the case was that the trial judge, in an attempt to apply the Health Care Services Lien Act, did not consider the out-of-pocket expenses in making the calculation.<span>\u00a0<\/span>That resulted in a zero recovery for the plaintiff after paying attorney fees, out-of-pocket expenses and the health care liens.<span>\u00a0 <\/span><\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/injury-lawyer\/health-care-liens-are-limited-to-40-of-verdict-after-deducting-attorney-fees-and-costs-stanton-v-rea-et-al\/#more-1538\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In 2003, plaintiff Amy Stanton was a passenger in a car driven by the defendant, Carolyn Rea.\u00a0Stanton was injured and hospitalized after the car crashed.\u00a0The driver of the other vehicle in the accident was uninsured.\u00a0In October 2007 the case proceeded to a jury trial.\u00a0The trial judge entered a verdict on liability against Rea on the [&hellip;]<\/p>\n","protected":false},"author":795,"featured_media":0,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"jetpack_post_was_ever_published":false,"footnotes":"","jetpack_publicize_message":"","jetpack_publicize_feature_enabled":true,"jetpack_social_post_already_shared":false,"jetpack_social_options":{"image_generator_settings":{"template":"highway","default_image_id":0,"enabled":false},"version":2}},"categories":[45,5],"tags":[],"class_list":["post-1538","post","type-post","status-publish","format-standard","hentry","category-auto-accidents","category-car-accidents"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Health Care Liens are Limited to 40% of Verdict After Deducting Attorney Fees and Costs; Stanton v.
