{"id":149,"date":"2013-08-29T10:00:37","date_gmt":"2013-08-29T16:00:37","guid":{"rendered":"http:\/\/www.chicagobirthinjurylawyersblog.com\/?p=149"},"modified":"2022-02-04T13:14:22","modified_gmt":"2022-02-04T19:14:22","slug":"jury-award-allowed-to-stand-in-willful-and-wanton-misconduct-procedure-in-medical-negligence-case","status":"publish","type":"post","link":"https:\/\/www.robertkreisman.com\/birth-injury-lawyer\/jury-award-allowed-to-stand-in-willful-and-wanton-misconduct-procedure-in-medical-negligence-case\/","title":{"rendered":"Jury Award Allowed to Stand in Willful and Wanton Misconduct Procedure in Medical Negligence Case"},"content":{"rendered":"<p><!-- [if gte mso 9]&gt;--><\/p>\n<p class=\"MsoNormal\">Illinois law prohibits punitive damages awarded in any medical malpractice case.\u00a0 However, in this medical malpractice case there was a separate count alleging that the <a href=\"http:\/\/www.uchospitals.edu\/index.shtml\">University of Chicago Hospitals<\/a> acted in willful and wanton indifference to the plaintiff\u2019s right to possession of her daughter\u2019s remains.<\/p>\n<p class=\"MsoNormal\">This lawsuit originated in the Circuit Court of Cook County after Valentina Dearring, the daughter of the plaintiff, Alexandria Drakeford, died at the University of Chicago Hospital on\u00a0April 10, 2003.\u00a0 Valentina was just over one month old when she died.\u00a0 She was born with <a href=\"http:\/\/emedicine.medscape.com\/article\/898437-overview\">persistent pulmonary hypertension of the newborn (PPHN<\/a>).\u00a0 This is a syndrome that is fatal in many infants.\u00a0 In April 2005, Drakeford filed suit against the University of Chicago Hospitals for medical negligence.<\/p>\n<p class=\"MsoNormal\">At first, the Drakeford lawsuit alleged only wrongful death and survival based on medical negligence. \u00a0However, an amended complaint added a second count alleging willful and wanton interference with the right of possession of the remains of Valentina.<\/p>\n<p class=\"MsoNormal\"> <a href=\"https:\/\/www.robertkreisman.com\/birth-injury-lawyer\/jury-award-allowed-to-stand-in-willful-and-wanton-misconduct-procedure-in-medical-negligence-case\/#more-149\" class=\"more-link\">Continue reading<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Illinois law prohibits punitive damages awarded in any medical malpractice case.\u00a0 However, in this medical malpractice case there was a separate count alleging that the University of Chicago Hospitals acted in willful and wanton indifference to the plaintiff\u2019s right to possession of her daughter\u2019s remains.
